The EU Pay Transparency Directive, which was approved in June 2023, was developed to close the 12.7% gender pay gap across the European Union. The Directive establishes a clear framework for EU member states to apply the principle of equal pay for equal work or work of equal value.
EU member states have until June 7, 2026 to transpose the Directive’s requirements into law. In response, Trusaic will be monitoring the status of each country’s transposition efforts and updating when there’s actionable development for which we can provide guidance for affected employers.
Applicable employers — those with 150 or more employees (this can vary by jurisdiction specifics) — must submit gender pay gap reports by June 7, 2027. Applicability is likely to vary by member state, as the requirements put forth by the Directive are minimum thresholds. Thus, countries can elect to expand the scope of employer size that must adhere to the reporting requirements.

| Estonia | On 16 April 2026, Estonia announced it would seek a potentially multi-year postponement and amendment of the EUPTD. Estonia’s Minister of Economic Affairs and Industry has stated that Estonia would rather pay a fine to postpone the EUPTD transposition in Estonia rather than increase the burden on businesses. Shortly after that announcement, the government decided in a cabinet meeting on a partial reversal of course, moving forward with a plan to strengthen legal clarity around the existing right to equal pay for equal work and incorporating certain EUPTD pre-employment pay transparency rights into Estonian law, such as the ban on asking an applicant for their salary history and the right to receive initial pay information before an interview. The draft of this law is to be submitted to the cabinet in April. |

| Finland | The Finnish government had originally targeted at May 18, 2026 implementation. However, that deadline will now be missed, and Finland will miss the 7 June 2026 deadline. The estimated week for the government proposal to be presented has been updated from Week 16 of 2026 (13 April – 19 April) to Week 25 (15 June – June 21). The government’s “Situation description” noted: “The implementation of the Pay Transparency Directive is delayed and the entry into force of the national legislation depends on the parliamentary processing schedule.” On 16 May 2025, Finland published its draft legislation to implement the EU Pay Transparency Directive. | Lithuania | Lithuania resolved a weeks-long legislative committee debate over the timing of its EU Pay Transparency Directive transposition and became the second EU Member State – after Slovakia – to pass legislation to fully transpose the EU Pay Transparency Directive. Rather than delaying the entire package, the Seimas Social Affairs and Labour Committee voted on 13 May 2026, to delay the effective date of certain requirements in the legislation: most requirements will enter into force on 7 June 2026, while two significant provisions — employer pay system compliance and data submission to the national social insurance authority — will not take effect until 31 Dec. 2026 and 1 Jan. 2027, respectively. The result is a two-track compliance timeline that will require Lithuanian employers to understand not just what is required, but when. On 21 May 2026, the Seimas adopted the transposition legislation (Law No. XV-969), which was then signed by the President and officially published in the Register of Legal Acts on 25 May 2026. |

| Romania | On 5 May, 2026, the incumbent Romanian government collapsed after a no-confidence vote. It is not clear when a new government will be formed, but the current situation means delay in the implementation of the Directive past the 7 June, 2026, deadline is likely.

| Spain | Spain’s Ministry of Labour and Social Economy launched a public consultation on a draft Royal Decree to transpose the EUPTD into Spanish law. The consultation is open from April 24 through May 8, 2026. Spain is seeking prior consultation, which means they are seeking to gather the opinions of citizens, organizations, and associations potentially impacted by the future legislation before the preparation of a draft decree. Therefore, unlike other public consultations that we have seen within the EU to date, the transposition legislation has yet to be drafted. Spain notes in its consultation that the deadline for transposing the Directive is June 7, 2026. However, after the prior consultation, the Ministry will then draft the transposition decree, which will then require additional consultation (Audiencia e Información Pública), review by any required institutional bodies (e.g. legal affairs and the Council of State), and approval by the Council of Ministers. Therefore, it seems highly unlikely that Spain will transpose on time.
Notably, the consultation states that “[n]o alternative solutions other than incorporating the new rights required by the Directive into the national legal system are considered,” which could be a sign that Spain is not going to be backing Sweden and Estonia in the push for renegotiation of the Directive.
