Introduction

Effective March 2020, Cincinnati Ordinance No. 83 requires employers with 15 or more employees located within the city to adhere to a salary history ban and pay transparency requirement. 

The law also pertains to job placement and referral agencies. State and local governments are excluded, with the exception of the City of Cincinnati.

Cincinnati Pay Transparency Requirements

Cincinnati’s law focuses on restricting employers from asking applicants about their salary history and preventing them from relying on any known salary histories in making a compensation offer.

Employers also must, upon reasonable request, provide a pay range for a position for which an applicant has been provided a conditional offer of employment.

The Risks of Non-Compliance

If an applicable employer fails to comply with any provision of the ordinance, the applicant shall have a private cause of action to enforce the provisions of Chapter 804-05 against the employer for compensatory damages, reasonable attorney fees, the costs of the action, and any legal and equitable relief deemed just and proper by the court.

Applicants have a two-year window from when the violation occurs to seek damages.
