By the year 2026, the IRS is expected to have issued more than $228 billion in penalty assessments for ACA non-compliance to employers. A 2018 TIGTA report estimated that more than 30,000 notices had been issued by the IRS with Employer Shared Responsibility Payment assessments of $4.5 billion for the 2015 tax year alone. That does not count the 2016 notices. More Letters 226J are on the way.
